Welcome to Legion Hosting! These Terms of Service ("Terms") govern your use of the Legion Hosting website (the "Site") and the game server hosting services, software, and support offered by Legion Hosting (collectively, the "Services"). By accessing the Site or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or Services.

1. Acceptance of Terms

By creating an account, purchasing, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy (available at /privacy-policy.html). You must be at least 18 years old or have the legal permission of a parent or guardian to use our Services.

2. Service Description

Legion Hosting provides game server hosting services, initially focused on Minecraft servers, with the intention to support additional games in the future. We offer various hosting plans ("Tiers") with different specifications (CPU, RAM, Storage) and pricing, including a free introductory tier ("Wood I") subject to specific limitations outlined on our pricing page. Features include, but are not limited to, server management tools, DDoS protection, NVMe/SSD storage, and customer support. Specific features may vary depending on the chosen plan.

3. User Accounts

• Account Creation: You must provide accurate and complete information when creating your account.
• Account Security: You are responsible for maintaining the confidentiality of your account login information (username and password) and for all activities that occur under your account. You agree to notify Legion Hosting immediately of any unauthorized use of your account.
• Account Responsibility: You are solely responsible for the content hosted on your server(s) and the actions taken using your account and Services.

4. Payment, Billing, and Refunds

• Fees: You agree to pay all applicable fees for the Services you select, as described on our Site at the time of purchase. Prices are subject to change with notice.
• Billing Cycle: Services are typically billed on a recurring monthly basis, unless otherwise specified (e.g., quarterly, annually).
• Payment: Payment is due in advance of the service period. We accept various payment methods as indicated on the Site. Failure to make timely payments may result in suspension or termination of your Services.
• Promotions: Promotional offers, such as the "50% off the first month," are subject to specific terms and conditions provided with the offer and may only apply to the initial billing cycle for new customers or specific plans.
• Free Tier: The free tier ("Wood I") is offered subject to availability and resource limitations as defined on our Site. Legion Hosting reserves the right to modify or discontinue the free tier with notice. Excessive resource usage or abuse of the free tier may result in suspension or a requirement to upgrade to a paid plan.
• Refunds: Refund policies will be specified on the Site. Generally, refunds may be available within a limited timeframe (e.g., 72 hours) for new orders, excluding certain fees like setup fees or domain names, if applicable. Refunds are typically not provided for renewal payments or after the initial refund period.

5. Acceptable Use Policy

You agree not to use the Services for any unlawful or prohibited activities, including but not limited to:

• Hosting or distributing illegal content (e.g., copyrighted material without permission, illegal pornography, pirated software).
• Engaging in activities that disrupt or interfere with our network, servers, or other users' services (e.g., DDoS attacks, network scanning, spamming).
• Hosting malicious software (viruses, malware, ransomware).
• Using excessive server resources that negatively impact server performance for others (specific limits may be defined per plan).
• Engaging in fraudulent activities.
• Violating the terms of service of the games being hosted.

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your Services without refund.

6. Service Level Agreement (SLA) & Reliability

Legion Hosting strives to provide reliable service. While specific uptime guarantees may be outlined in a separate SLA document if offered, we implement measures such as:

• DDoS Protection: We provide DDoS mitigation to protect your server from common attacks.
• Network: We utilize high-speed network connections aiming for low latency.
• Hardware: We use quality server hardware appropriate for the selected tier.
• Power Backup: Our data centers employ redundant power systems (e.g., UPS, generators) to minimize downtime due to power outages.

However, scheduled maintenance, unforeseen hardware failures, network issues beyond our direct control, or violations of these Terms can affect service availability. We are not liable for downtime caused by factors outside our reasonable control.

7. Intellectual Property

All content on the Site, including text, graphics, logos, and software, is the property of Legion Hosting or its licensors and is protected by intellectual property laws. You retain ownership of the content you upload to your server(s), but grant Legion Hosting the necessary licenses to host and transmit that content as part of providing the Services.

8. Limitation of Liability

To the maximum extent permitted by law, Legion Hosting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Services.
• Any conduct or content of any third party on the Services.
• Unauthorized access, use, or alteration of your transmissions or content.

In no event shall Legion Hosting's aggregate liability exceed the amount you paid Legion Hosting, if any, in the past six months for the Services giving rise to the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless Legion Hosting, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Services, or your violation of these Terms.

10. Termination

• By You: You may terminate your account and Services at any time by following the procedures outlined on the Site or contacting support. Fees paid in advance are generally non-refundable beyond the initial refund period.
• By Legion Hosting: We may suspend or terminate your account and Services immediately, without prior notice or liability, for any reason, including breach of these Terms or the Acceptable Use Policy. Upon termination, your right to use the Services will cease immediately, and data on your server may be deleted.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Iowa, United States, without regard to its conflict of law provisions.

12. Changes to Terms

Legion Hosting reserves the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide reasonable notice (e.g., via email or a notice on the Site) prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
